Convenient and Legally Recognized Marriages in Pakistan

Online Nikah

Online Nikah Service presents a unique opportunity for Pakistanis residing abroad who are unable to physically participate in the Nikah process or attend their marriage due to various reasons. This service is made possible by the provisions in Pakistan’s Marriage laws and Sharia (Hanfi School of Thoughts), which allow individuals to perform online marriages in Pakistan by appointing a lawyer (Attorney).

It is important to note that for online nikah/online marriages in Pakistan, it is not mandatory for both spouses to be Pakistani citizens. If either spouse is a citizen of Pakistan, they can register their marriage through this service.

Unlike in some Middle Eastern countries, such as the U.A.E, Saudi Arabia, Oman, Iraq, etc., where a female cannot perform Nikah without a wali (guardian), Pakistani Marriage laws do not impose such a requirement. Therefore, no Wali is necessary to perform an online Nikah in Pakistan. A special clause has been included in the Pakistani Nikah nama, allowing the appointment of Vakeel/Representatives on behalf of the marrying couples.

To have their marriages registered in Pakistan while living abroad, Pakistanis or foreign nationals must appoint a lawyer who will handle the Nikah process and paperwork on their behalf.

Hamara Qanoon, the leading family and marriage law firm in Pakistan, specializes in online Nikah services worldwide. With a wealth of experience, we have successfully conducted hundreds of online marriages around the globe.

Online Nikah Procedure:

To facilitate a smooth online Nikah process, we follow the following steps:

Step 1: Clients are required to email or whatsapp us their passport/ID card copies and relevant particulars.

Step 2: We schedule a convenient date for the Nikah ceremony, where both the bride and groom will join us via video call.

Step 3: During the scheduled video call, our Qazi/Nikah Khawan recites the Khutba-e-Nikah (sermon) and administers the Ejab o Qabool (offer and acceptance) in the presence of the appointed Vakeels and two Muslim Nikah witnesses.

Step 4: After the Nikah ceremony, we process the necessary legal documents for the signatures of both parties. These documents include the registration of Nikah nama (marriage contract) and issuance of the NADRA Marriage Certificate (MRC). Additionally, we can provide translations in English or Arabic, along with notary public or foreign affairs’ attestation if required and upon receiving the duly signed documents.

Upon availing the online Nikah service and based on your selected payment package, you will receive the following Nikah documents:

  • Registration of Nikah nama
  • Copies of Urdu Nikah Nama
  • Nikah nama in English/Arabic translations
  • NADRA Marriage Certificate (MRC)
  • Notary Public/Foreign Affairs’ attestation (if agreed)
  • Attestation from the Concerned Embassy (if agreed)

We process these documents through the relevant government departments authorized by the Government of Pakistan. The Union Council/Arbitration Council and NADRA maintain complete records of your marriage details. Thus, the delivered documents are authentic and reliable, and you can independently verify these details.

Requirements for Islamic Weddings:

To perform an Islamic wedding, the following requirements should be fulfilled:

  • The man and woman should be adults and non-mahram (not closely related).
  • Both parties must give their consent to the marriage.
  • The Nikah ceremony should be conducted in the presence of two Nikah witnesses.
  • Agreement on the amount of Mehr (dower).

Can Muslim women marry without a Wali?

According to Article 35 of the Constitution of Pakistan and the judgment of the Federal Shariat Court, the consent of a ‘Wali’ (guardian) is not required for a Sui juris (capable of entering into legal contracts) Muslim female to enter into a valid Nikah/Marriage based on her own free will, without the consent of a Wali. (PLD 2005)

Our Online Nikah Procedure:

Our online Nikah procedure adheres to the accepted guidelines of the Hanafi Islamic school of thought. During the Video Conference Nikah Service, we ensure that all essential Nikah conditions are fulfilled, including:

  • Presence of two male witnesses
  • Offer and acceptance by the respective spouses
  • Vakeel/Representatives from both parties
  • Fulfillment of the obligatory condition of Mehr (dower amount)

Based on the clarity of the Nikah conditions mentioned above, it is not necessary for the bride or groom to personally attend the Nikah ceremony. Instead, they authorize us to appoint someone as their Vakeels to pronounce the offer or acceptance for Nikah on their behalf. This process complies with both legal and Sharia requirements. By fulfilling these four conditions, the process remains fully compliant with Sharia law.
